Terms of Service
|
D2 Hosting requires that all users agree to the TOS (Terms of Service) mentioned hereon. Upon enrolling in the services provided by D2 Hosting, the Customer acknowledges acceptance of the Terms of Service. D2 Hosting reserves the right to change and otherwise modify the TOS without notification. It is the sole responsibility of the Customer to request the most current TOS. The conditions of the TOS are as followed:

The User agrees to provide D2 Hosting with current and accurate information upon enrolling. Any information found to be falsified is grounds for account termination as decided by the company. The user must provide a contact address, for either electronic mail or US mail. D2 Hosting will contact the Customer by means of this address and is not responsible for the misdirection of any information due to fraudulent information provided by the User.

All services provided by D2 Hosting have a required payment, which may change at the discretion of the Company. Upon enrolling for services provided by D2 Hosting, the Customer agrees to the following conditions of payment.

The Customer agrees to pay the amount quoted to them on the Order Receipt sent by electronic mail to the address the User specified at the time of registration. If the amount listed is not what the user agreed to pay, notification must be sent to D2 Hosting by the 3rd day prior to registration. If D2 Hosting is not informed of an error by the 3rd day, the user is responsible for payment as listed in the receipt.

At the time of registration, payment for the first 30 days of service will be due. If the Customer is not paying by electronic means, payment must be received or otherwise received with a postmark by the date specified in the Order Receipt.

The Customer will be billed 30 days after registration for the amount listed on the Order Receipt. If the Customer is not paying by electronic means, payment must be received or otherwise received with a postmark by the date specified in the Order Receipt.

The Customer agrees that in addition to regular billing, there may be additional fees as a result of the following:

Exceeded Bandwidth Limitation: As shown in the Order Receipt, the User will be given an account with a certain amount of bandwidth per month. There is a $2 minimum per Gigabyte of excess bandwidth charge for any user in violation of their quota. If the User exceeds this amount, under intentional, accidental, or uncontrollable conditions, the User is required to pay the calculated total as given by D2 Hosting. Accounts may be suspended or otherwise terminated at any time due to excessive bandwidth violations, as determined by D2 Hosting.

Late Payment: Any payments not received within the said grace period, per the Order Receipt, will result in a late fee. Fees will be assigned as $1 per late day with a $5 minimum fee. Accounts with credit cards that have expired or are otherwise declined will be charged a $10 delinquent fee. Accounts will be given, but not limited to, a 15 day grace period. If payment is not received 15 days after the expected date, the account may be suspended or otherwise terminated as D2 Hosting sees as appropriate. Upon being suspended or terminated, the user will be given a final assessment of all collective charges and fees.

Delinquent Accounts: Any outstanding fees or debts at the time of cancellation must be paid within 15 days of account termination. If no payment is received by the given time, D2 Hosting will reserve the right to turn the delinquent account over to a third party collection agency if necessary.

In the event that the Customer wishes to cancel his or her account, it is the responsibility of the user to notify D2 Hosting either by electronic mail (sales@d2hosting.com) or by US mail at the contact address found at d2hosting.com. A reply will be sent confirming cancellation within 48 hours.

If there is a valid dispute over billing accuracy or any other type of disagreement, the customer must notify D2 Hosting no later than 3 days after receiving an erroneous bill. D2 Hosting will solely resolve all issues as seen fair by the Company. Refunds will be made in full without the application of restocking, service, shipping, or any other fees.

The Customer and anyone operating under the services of the Customer must maintain appropriate content on the server. If the Customer chooses to rent or otherwise allow other users to have access to his or her account, then the Customer agrees to inform those individuals of the appropriate content standards as listed heron and will take full responsibility for any violations they may incur. Any of the following material is grounds for account termination. This includes, but is not limited to:

The transfer or storage of any illegal, pirated, hacked or otherwise misused software, code, music or any other unlawful digital media.

Serial codes, keys, activation numbers, keygens or any other media by which one may crack or bypass a copyright on any protected digital media is prohibited.

Material which may be considered threatening, slanderous, profane, obscene, or pornographic is prohibited. D2 Hosting reserves the right to deny posting of any questionable material.

Sending or abating third parties in the act of sending any form of unsolicited e-mails, ‘junk mail’ or ‘spam’ is prohibited.

Collecting any form of information for the purpose of theft, unlawful contests, scams, or any other questionable purpose is prohibited.

Any act which is illegal under any applicable law or government is prohibited.

D2 Hosting will not be held liable for any illegal or offensive material placed on the server by other users. Each user is responsible for their own content.

The Customer and all users of the server agree not to attempt or execute any action which would cause harm to D2 Hosting, the server, the service providers of D2 Hosting or any clients of D2 Hosting. This includes but is not limited to:

The sending, execution or any form of transmission of a computerized virus, worm, or form of propagating computer bug.

Attempting to interfere with the normal operation of D2 Hosting or any of its clients.

Any form of forgery or unauthorized modifying of information.

Any attempt to access or erase unauthorized information.

D2 Hosting is not responsible for any unanticipated occurrences on the server. Every attempt will be made to ensure that the server operates in a reliable and optimal condition, but there is no guarantee that these conditions will always exist. D2 Hosting does not maintain responsibility for disruptions on the server caused by, but not limited to:

Server downtime caused by third party actions or otherwise uncontrollable circumstances.

Denied access to user accounts or functions of user accounts due to settings and configurations made by the User.

Any form of data loss caused by either computer or human error. D2 Hosting is not responsible for any mechanical or accidental deletion of individual materials. All users are responsible for their own backups of information contained on the server.

Cancellation of services provided to D2 Hosting.

All efforts will be made to ensure reliable service. However, D2 Hosting will in no way assume any form of responsibility or compensation for the loss of data or any profits, time, or other resources that may be lost as a result of server failure. Each individual is responsible for the backup of personal records and materials. Users must maintain their user names and passwords and D2 Hosting will not be held responsible for any lost personal records. There is no warranty or guarantee from D2 Hosting on the reliability of the server. Refunds or other forms of compensation for downtime may be considered per each case; however, D2 Hosting reserves the right to deny all such requests.

Any information collected or imparted by the customer will not be shared, rented, sold, given, or otherwise transferred to any third party for any reason other than to facilitate a transaction or address a customer service concern.

If any user or sub-user of the Terms of Service violates the above mentioned TOS, any accounts may be suspended or otherwise terminated as seen appropriate by D2 Hosting. The Customer is responsible for compliance with the latest version of the TOS viewable at d2hosting.com. D2 Hosting reserves the right to deny, revoke or limit service to any individual or user.
